1. Acceptance of Terms
By accessing and using Coldcase (“the Platform”), operated by Nerdbeak, Inc., you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, do not use the Platform.
2. Description of Service
Coldcase is a collaborative cold case investigation platform that enables users to browse, research, and discuss unsolved cases. Users may upload evidence, share theories, and collaborate with others. Coldcase is not a law enforcement agency and does not conduct official investigations.
3. Account Tiers and Subscriptions
Coldcase offers the following account tiers:
- Cadet (Free) — Browse cases, follow investigations, view evidence previews, and read community theories.
- Analyst (Per Case) — Subscribe to individual cases ($5-50/month set by the Detective) to add evidence, theories, and collaborate.
- Detective ($29/month) — Create unlimited cases, 100GB evidence storage, Toby AI assistant (50 messages/day), set your own subscriber pricing, and earn 80% of subscriber revenue.
- Special Agent ($79/month) — Everything in Detective plus 500GB storage, Toby AI (200 messages/day), video and audio uploads, 90% revenue share, and priority support.
Subscriptions are billed monthly through Stripe. You may cancel at any time, and your access will continue through the end of your current billing period. Refunds are not provided for partial months.
4. Creator Revenue and Payments
Detectives may set a monthly subscription price ($5-50/month) per case for access to their investigations. Revenue is split between the creator and Coldcase according to your plan tier (80/20 for Standard, 90/10 for Pro). Payouts are processed through Stripe Connect to your connected bank account on a rolling basis, typically within 2-7 business days. Coldcase reserves the right to withhold payouts if fraudulent activity is suspected.
5. Community Guidelines
Coldcase is a platform for respectful, collaborative investigation. Users must:
- Treat all cases and victims with respect and sensitivity
- Avoid speculation that could harm individuals or families of victims
- Share only factual information and clearly label theories as such
- Respect privacy and never engage in doxxing or harassment
- Not interfere with official law enforcement investigations
- Report credible leads or evidence to appropriate law enforcement authorities
- Follow all applicable laws and regulations
6. Content and Conduct
Users are responsible for their content and conduct on the Platform. We reserve the right to remove content or suspend accounts that violate our guidelines without notice. Content that encourages vigilante justice, harassment, or interference with official investigations will be immediately removed.
7. Intellectual Property
Users retain ownership of their original content, including theories, analysis, and commentary. By posting content on Coldcase, you grant Nerdbeak, Inc. a non-exclusive, worldwide license to display and distribute such content on the Platform. Detectives retain full ownership of their case investigations and may export their data at any time. Public records referenced on the Platform remain in the public domain.
8. Evidence and File Uploads
Users are responsible for ensuring they have the right to upload any files or evidence to the Platform. Do not upload classified, stolen, or illegally obtained materials. Storage limits are enforced per your account tier (100GB for Detective, 500GB for Special Agent). Files are stored securely and encrypted at rest.
9. AI Features
The Platform includes Toby, an AI assistant powered by third-party AI services. AI-generated responses are provided for informational purposes only and should not be treated as factual conclusions. Coldcase is not responsible for the accuracy of AI-generated content. Case data may be sent to AI providers for processing, subject to their privacy policies.
10. Disclaimers
Coldcase is a platform for discussion and collaboration. We do not guarantee the accuracy of information shared by users and are not responsible for the outcomes of investigations. The Platform is provided “as is” without warranties of any kind. Users should report any credible findings to law enforcement rather than acting on them independently.
11. Limitation of Liability
To the maximum extent permitted by law, Nerdbeak, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
13. Changes to Terms
We may update these terms from time to time. We will notify users of material changes via email or through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised terms.
